Vanuatu: Venturesome Experiences Come with an Acceptance of Increased Risk and Liability.

Vanuatu is considered to be a safe country, whose people are affable, friendly and only too willing to help others. It is full of fascinating attractions, activities, and imbued with rich culture and customs. The unspoilt and untouched nature of Vanuatu is both one of its biggest attractions but also presents a far greater risk and greater consequences to travellers where heightened hazards and dangers exist.

There is an inverse relationship between venturesome settings/environments and readily available civil defence and first responder services. Further, the cultural distance between visiting traveller and island resident is at times significant and travellers need to understand that they are the foreigner and therefore adjust to the understanding and societal norms that they wish to experience.

These Terms and Conditions impose weighty impositions and stipulations in regard to the amount of risk and liability they must accept in visiting on guests and participants making a booking through Vanuatu Traveller. No apology is made for this and is the consequence of travelling in a developing country and is a necessary requirement.

A Lack of Infrastructure & Facilities.

Vanuatu is categorised by the United Nations as a Least Developed Country (LDC) and as such there is a significant lack of infrastructure development that not only includes makeshift roads, power, water and telephone, but also only basic health, medical, and education facilities. Services that travellers from developed countries assume and expect simply do not exist or at best are at a rudimentary stage.

A Lack of Knowledge about Tourism and Outsiders.

Almost 70% of all Ni-Vanuatu livelihoods are based on subsistence farming and the country possesses no social safety net for its people. They have little expectation of what help they would receive themselves should a catastrophe occur around them.

Further, the general population have minimal education and virtually no contact or knowledge of outsiders and their ways. Through their physical way of life, they have no understanding that visiting travellers may not be able to carry out activities and actions that they and their children perform with ease. Ni-Vanuatu infants under two years will commonly handle and play with extremely sharp knives without consequence. Based on their own way of life Ni-Vanuatu will merely assume that travellers are capable at all times.

1.0 DEFINITION OF WEBSITE".

'Vanuatu Traveller Website', ‘Website’, 'Site' means the booking portal at https://vanuatutraveller.com along with its associated website www.tanna-adventures.com. Where reference is made to https://watt.nz through iframes or other references this shall also be taken as being taken as belonging to the https://vanuatutraveller.com website.

2.0 DEFINITION OF VANUATU TRAVELLER".

'Vanuatu Traveller', 'Tanna Adventures', 'us', 'We', 'owner', 'our', 'Associated Tourism Operators and Agents', https://vanuatutraveller.com, www.tanna-adventures.com shall all be taken as meaning Vanuatu Traveller.

3.0 DEFINITION OF CUSTOMER, PURCHASER, GUEST and PARTICIPANT.

'Customers' and 'Purchasers' mean the same thing and shall be taken as meaning 'Guests' or 'Participants' or both 'Guests' and 'Participants' concurrently. While the name of the customer(s) may only be one name it identifies the whole group and shall mean every person in this group of Customers(s)that are a part of the booking.

'Guests', 'You', 'Your', 'Your Party', 'members' shall mean the entity, entities, person, and/or persons that have agreed to occupy, stay at, and use the accommodation property booked through Vanuatu Traveller. The entity / person addressed on the 'Confirmation Email' and 'Formal Documents' is denoted on that documentation as the 'Guest' but shall be taken as including all persons included within the numbers of persons booked by that entity / person and included in the numbers stated in that 'Confirmation Email'.

'Participants', 'You', 'Your', 'Your Party', 'members' shall mean the entity, entities, person, and/or persons that have booked to participate in or on a Vanuatu Traveller 'Tour' or 'Walk' or any other activity arranged or organized by Vanuatu Traveller. By definition the entity / person addressed on the 'Confirmation Email' and 'Formal Documents' is the 'Participant', but shall include all persons included within the numbers of persons booked by that entity / person and included in the numbers stated in that 'Confirmation Email'.

4.0 DEFINITION OF AGREEMENT BETWEEN CUSTOMERS AND VANUATU TRAVELLER".

'Terms and Conditions','T and C', 'T & C', 't&c', 'Agreement', 'Contract' shall mean the set of provisions, rules and standards that form the agreement between 'Customers' (including both 'Guests' and 'Participants') and 'Vanuatu Traveller' for Trips, Accommodation, Tours and Walks and/or any other Activities in Vanuatu.

5.0 DEFINITION OF "CONFIRMATION EMAIL".

'Confirmation Email', 'Formal Documents', shall mean the email sent by 'Vanuatu Traveller' to the 'Customer(s)' subsequent to a booking having being made by the later with the former.

6.0 DEFINITION OF "COMMENCEMENT".

Commencement of your first activity or stay with us shall be denoted here as Commencement.

 
1.0 YOUR RESPONSIBILITY TO INFORM YOURSELF.

It is your responsibility to have read and understand these Terms and Conditions before making a booking and paying a deposit.

2.0 INDEMNITY.

Vanuatu Traveller will not be responsible for any actions taken by you if you act in any manner which is inconsistent with these Terms and Conditions. By accessing the Site you agree to indemnify and hold harmless Vanuatu Traveller, its employees and agents from and against all actions, proceedings, suits, claims and demands brought or made against Tanna Adventures by any person arising from or as a consequence of such an action and from and against any damage, loss, cost or expense suffered or incurred by Tanna Adventures as a direct or indirect consequence of that action.

3.0 SEVERENCE.

If any provision of this agreement is found to be void, unenforceable or illegal it is to be read down so as to be valid and enforceable, or if that cannot be done, the provision (or where possible the offending words) is to be severed from this agreement without affecting the validity, legality or enforceability of the remaining provisions of this Agreement which will continue in full force and effect.

4.0 GOVERNING LAW TO TERMS AND CONDITIONS.

The Laws governing these Terms and Conditions, shall be the laws of the Country of New Zealand.

1.0 Information on Vanuatu Traveller website.".

While Vanuatu Traveller makes every effort to ensure that information on its website https://vanuatutraveller.com is current and kept up to date, this information may change without notice. Descriptions, details and advice is made in good faith and all photos on this 'Website' were taken 'on site' and are provided as a guide only.

2.0 Your Access to Website is Conditional.

Your access to the Website is conditional upon your acceptance of and compliance with all terms, conditions, notices and disclaimers set out in these Terms and Conditions.

3.0 Material Content Disclaimer.

Vanuatu Traveller makes no representations about the content and suitability for any purpose of the information contained in the Site. It is provided "as is" without an express or implied warranty of any kind. Tanna Adventures disclaims (to the full extent allowable by law) all warranties with regard to this information (including any advertisements), including all implied warranties as to merchantability or fitness for use. Vanuatu Traveller shall not be liable for any damages whatsoever including any special, indirect or consequential damages resulting from loss of use, data or profits, whether in an action in contract, negligence or other tort or statute arising out of or in connection with access to the Site or the use or performance of information contained in it. Neither Vanuatu Traveller nor any of its employees participating in the provision of information to the Site warrant that the Site will be uninterrupted or error-free.

4.0 Travel Blog Content.

All travel Blog content is ported via "iframes" from the travel blog website https://watt.nz which is written by Greg Watt, and whose content is derived from his research and views. While it is intended to be an independent travel voice and is written as such, it's content is included within Vanuatu Traveller as an invaluable resource to travellers. It is acknowledged that Greg Watt has an involvement in both websites.

1.0 COLLECTION OF INFORMATION.
  • When you sign up online to receive https://vanuatutraveller.com or https://watt.nz newsletters, traveller information sheets and other products, you must provide your name, email address, and a password. We never sell or rent your email address or other personally identifiable information you provide us under these circumstances.
  • When you order information sheets, and other literature directly from us, we add you to our email list, and we'll send you general information and marketing pieces from ourselves.
2.0 NEWSLETTERS.

We use 'Mailchimp' for our newsletters, who are an independent newsletter specialist website. Provision is provided within their newsletter format to update or unsubscribe from our email newsletters.

3.0 3.0 ANALYTICS.

We use 'Google Analytics' to anonymously analyse the use of our website by tracking information such as page views, traffic flow, search items, and click through. We use this information to improve our site. We do not share any of this information and we are not able to identify any individual user.

4.0 USE OF INFORMATION.
We use information we collect as follows :
  • Email address which you have provided is used to send occasional newsletters, updates and related products or service information.;
  • To improve both our website and customer service.We take on board the information and feedback you provide to us, along with customer support requests.
5.0 DISCLOSURE TO OTHERS.
  • We do not disclose your information to outside parties, except those that are involved with us in operating our business(es) and website(s), who are required to keep this information confidential;
  • Where required by law, or to protect our rights and those of others, enforce our site policies or protect property or safety, we may release all or part of your information.
  • No personally identifiable information is provided to other parties for marketing or advertising.
6.0 PERSONAL INFORMATION COLLECTED FROM CHILDREN.

Unless otherwise disclosed during collection and with parent or guardian consent, we do not knowingly collect personal identifiable information from children under 16 years of age. If you are under 16 years of age you should not under any circumstance provide personally identifiable information to us. If we discover that a child under the age of 16 has provided us with personally identifiable information, we will immediately delete that child's information from our site.

7.0 YOUR CONSENT.

By using our site, you consent to our websites privacy policy.

8.0 CHANGES TO OUR POLICY.

If we change our privacy policy, we will post these on this page and change the privacy policy modification date.

1.0 YOUR PAYMENT TO US.
  • Deposit - You pay a Deposit at the time of making your booking with us.
  • Final Payment - You pay your Final Payment at least to fourteen(14) days prior to Commencement. You can also choose to make full payment (Deposit + Final Payment) at the time of booking.
2.0 PAYMENT CURRENCIES.

Depending on the method of Payment, it is possible to make payment in various currencies. Our foundational currency is Australian Dollars (AUD) and where purchasers wish to make payment in other currencies, the FX rates incorporated within each particular method of payment will determine the final amount in the purchasers preferred currency:

  • Paypal - Payments in American Dollars USD, Australian Dollars AUD, and New Zealand Dollars NZD.
  • Bank Transfers - Payments in Australian Dollars AUD, and New Zealand Dollars NZD.
  • Stripe Gateway - Payments available within the Stripe Gateway.
3.0 DEPOSIT PAYMENTS SECURES A BOOKING UP TO 14 DAYS PRIOR TO COMMENCEMENT.

By paying the Deposit you will secure a booking up to 14 days prior to commencement. Once we have received clear Deposit funds we will send you your Formal Documentation (PDF format) by email to the email address you have provided us. This consists of our official receipt along with your formal itinerary, which also provides you the breakdown of your Deposit, along with a clear statement of what is left to pay for your Final Payment.

4.0 PAYMENT OF FINAL PAYMENT.

Details regarding making the Final Payment shall be emailed to the email address you have provided us.

5.0 IF FINAL PAYMENT IS NOT PAID 14 CLEAR DAYS PRIOR TO COMMENCEMENT.

Should you not make your Final Payment 14 clear Days prior to commencement you have effectively cancelled your booking. In this case your Deposit is fully non-refundable. If you have any major extenuating circumstances, please contact us prior to the 14 day deadline occurs.

6.0 All DEPOSITS ARE NON-REFUNDABLE AFTER COMMENCEMENT.

Once commencement has taken place, all Deposits regardless of whether they are for accommodation, tours & walks, or trips are non-refunable.

1.0 YOU ARE OBLIGATED TO NOTIFY US.

If you cancel your booking for any reason, you must notify us in writing (by email is sufficient provided we provide a confirmation email that we have received it).

2.0 CANCELLATION 28 DAYS (OR MORE) PRIOR TO COMMENCEMENT.

For cancellations made more than 28 days away from Commencement - 100% of both your Deposit and anyFinal Payment if made, will be refunded (minus bank/merchant facility fees).

3.0 CANCELLATION BETWEEN 14 - 28 CLEAR DAYS PRIOR TO COMMENCEMENT.

For cancellations made less than 28 clear days away, but more than 14 clear days away from Commencement - 50% of your Deposit plus 100% of anyFinal Payment if made, will be refunded (minus bank/merchant facility fees).

4.0 CANCELLATION LESS THAN 14 CLEAR DAYS PRIOR TO COMMENCEMENT.

For cancellations made less than 14 clear days away from Commencement - 0% of your Deposit plus 50% of anyFinal Payment if made, will be refunded (minus bank/merchant facility fees).

5.0 IF YOU SIMPLY DON'T TURN UP.

If you simply do not turn up without notifying us in writing you shall be taken as a No-Show, and in this case both your Deposit and Final Payment are fully non-refundable.

6.0 EARLY DEPARTURE FROM ACCOMMODATION.

No refund will be given for early departure from your accommodation after commencement and you will be required to pay for the full time of your accommodation booking (both Deposits and Final Payments).

7.0 INCLEMENT WEATHER AND ILLNESS: ACCOMMODATION.

Refunds cannot be made for bookings cancelled after commencement due to inclement weather or illness, and you will be required to pay for the full time of your accommodation booking (both Deposits and Final Payments).

8.0 CHOOSING NOT TO PROCEED: TOURS & WALKS.

Please note that our Tours & Walks take place rain or shine. If you choose not to proceed on a Tour or Walk for any reason (including illness) except for severe inclement weather you will be required to pay for the full amount of your booking (both Deposits and Final Payments).

9.0 SEVERE INCLEMENT WEATHER OR CONDITIONS: TOURS & WALKS.

Should severe inclement weather or conditions occur the tour operator will notify you that booked Tours & Walks are cancelled for that day. The Tour Operator or Tourism Facility shall be the final adjudicator on whether a Tour or Walk is able to proceed. If possible, itineraries will be rearranged so that they are able to be undertaken on a different day or time. If rearranged itineraries are not possible then limited refunds are available. All Deposits are non-refundable however their associated Final Payments are fully refundable if the Tour or Walk has not already commenced. Conversely, if we have transported you to a Tourism Facility and that Facility has closed for that day or period then you will be refunded only the Final Payment associated with that particular Tourism Facility.

10.0INCLEMENT WEATHER, CONDITIONS OR ILLNESS: SEE & DO TRIPS.

See & Do Trips are a combination of Accommodation and Tours & Walks, and all aspects regarding inclement weather or conditions, along with any illness shall be covered by clauses 6.0 through 9.0 above.

10.0CANCELLATION BY VANUATU TRAVELLER - BOOKED ACCOMMODATION.

If booked accommodation becomes unavailable for occupancy before or during your stay due to damage to the Premises, or due to the need to carry out emergency repairs as a result of damage to the premises or due to circumstances beyond the reasonable control of Vanuatu Traveller, we will endeavour to find suitable alternative arrangements for your stay. If satisfactory alternative arrangements cannot be made, we will refund monies paid for that part of the booking not fulfilled.

10.0CANCELLATION BY FORCE MAJEURE

If a booking is required to be cancelled due to Force Majeure guests / participants will need to contact their insurance provider immediately to discuss their needs and whatever coverage their insurance policy will provide. In such circumstances Vanuatu Traveller has no obligations and responsibilties in regard to any bookings from the time of the start of the Force Majeure circumstances. However, Vanuatu Traveller will liaise with the relevant authorities to facilitate guests/participants evacuation from the area affected area where this is possible and feasible to do.

1.0 BOOKINGS CANNOT BE ASSIGNED TO OTHERS WITHOUT APPROVAL.

It is not permissible to assign any or all of your Booking to other people or entities without the written approval of Vanuatu Traveller.

2.0 BOOKINGS MAY BE TRANSFERED TO A LATER DATE.

It is permissible to transfer Bookings to a later date provided:

  • Bookings may be transfered once only, and
  • The re-booked Commencement date is not later than twelve(12) months after the original Commencement date, and
  • The cost of the booking shall be revised to the cost published on the website at the time of making the booking transfer (that is, there may be an extra amount payable due to increased prices), and
  • Any extra Accommodation, and Tours & Walks included in your transfered booking, if any, are paid for extra. It is noted that in the re-booked (future transfered booking) there may be only Minor, or alternatively there may be Substantial changes made to the original booking.
3.0 PAYMENTS OF TRANSFERED BOOKINGS.

Payments shall be made as follows:

  • The applicable tariff's at the rebooked date (if they are different to the initial tariff's) are applied to the entire booking, and the original amount deducted.This amount due is the Payment Difference.
  • If the Payment Difference isMinor then the initial Deposit paid shall be held over by Vanuatu Traveller for the transfered booking, with any tariff difference due paid by the guest/participant at the time of making the Final Payment (that is, all the adjustment is made in the Final Payment) , or
  • If the Payment Difference isSubstantial then a revised Deposit and Final Payment is to be calculated and any Payment Difference in Deposit is to be paid at the time of rebooking (that is, adjustments are made in both the Deposit and Final Payment).
1.0 YOU ACCEPT THE RISKS PRESENTED BY BEING CLOSE TO ACTIVE VOLCANOES.

Participants should note that visiting an active volcano is potentially very dangerous. It is your own responsibility to acquaint yourself with all possible hazards associated with being in close proximity to a Volcano and their consequences to yourself and those travelling with you. You acknowledge that our decision to travel is made in the light of consideration of this information and you accept that you are aware of the personal risks associated with participating in one of Vanuatu Traveller's Mt Yasur Volcano Tours.

2.0 YOU SHALL FOLLOW THE ADVICE AND GUIDANCE OF THE MT YASUR VOLCANO GUIDES.

Mt Yasur Volcano is administered by a Private Company appointed by the Vanuatu Government, who employ Volcano Guides to manage and guide visitors to the Volcano. As such, the entrance to and the governance of Mt Yasur Volcano lies with the "Mt Yasur Volcano Guides", who charge an entrance fee ( which is included in your Tour package), and who are responsible for managing whether the Volcano is open (safe to view), and where people are permitted to view from. Your entrance onto any part of the region managed by the "Mt Yasur Volcano Guides" shall constitute your agreement that you will at all times follow their advice and instructions.

2.0 VOLCANIC ALERT LEVELS.

The alert level for Mt Yasur is updated on the Vanuatu Government Vanuatu Geohazards Observatory Website https://www.vmgd.gov.vu/vmgd/index.php/geohazards/volcano, and you undertake where possible to familiarise yourself with both the alert level and what that means for travellers wanting to see the Volcano. Specifically :

L1Normal low-level activity.

L2Increased activity, danger near crater only.

L3Moderate eruptions, danger close to the volcanic vent.

L4Very large eruption, island-wide danger.

These levels provide you with up to date information on what you are likely to expect during your time on the Volcano. Despite this, you understand and accept that conditions on any volcano are unpredictable and may change suddenly at any time.

Once on the mountain, you are the responsibility of the Mountain Administration and you must follow the directions of the Volcano Guides at all times.

Officially, you are unlikely to be able to get near the Volcano if there is a Level 4 alert, and you will be kept at a distance from the volcano if there is a level 3 alert. For Level 2 it will be up to the Volcano Guides who Manage and Administer visitors to the Volcano, how close you are able to go. Depending on the circumstances, if magma is being thrown over the rim (rare), you may be limited to the carpark, if it is hurling at the upper interior sides of the volcano, you may be limited to the first flat viewing area (which is slightly away from the rim). For Level 0 and Level 1 alerts you will likely be allowed on the rim ( two different arms), giving you views directly down into the Volcano vents.

 
1.0 TRIPS, TOURS & WALKS INVOLVE RISK AND INTERACTION WITH HAZARDS.

You acknowledge that various Trips, and Tours & Walks that you may go on are adventurous and your participation involves a degree of personal risk. It is your own responsibility to acquaint yourself with all possible hazards and their consequences to yourself and those travelling with you. You acknowledge that your decision to travel is made in the light of consideration of this information and you accept that you are aware of the personal risks associated with participating.

2.0 YOU SHALL ENSURE THAT YOU DO NOT OVERREACH YOUR COMPETENCY OR ABILITY.

You shall ensure that both yourself and any member of the group of people that you have booked on behalf, do not overreach their competency or ability in regard to any physical endeavour whatsoever, whether that is associated with a Tour or Walk, or on any property booked through Vanuatu Traveller. Should you or any member of your group feel that they are about to overreach their abilities, they are to notify the Tour or Walking Guide, or the relevant Vanuatu Traveller Supervisor. At that time you shall discuss your situation with that Guide or Supervisor and subsequent to this, you shall decide either to continue with help, or alternatively to wait until a designated person arrives to help you proceed back to the starting point.

3.0 CHILDREN ON TOURS & WALKS.

You shall ensure that children are adequately supervised by yourself, at all times to ensure their safety, and you are to be extra vigilant around hazards which may pose dangers to them on Walks, Tours and on any property booked through Vanuatu Traveller generally, at any time of day or night.

4.0 EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY.

You understand and acknowledge that your travel in connection with and participation in the travel package arranged at your request by Vanuatu Traveller may involve risk and potential exposure to accident and major injury. In recognition of the inherent risk of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in the activity, that you are willingly and knowingly electing to participate in this travel package in spite of the potential risk of danger, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether caused in whole or in part by the negligence of the owners, agents, employees, or subcontractors of Vanuatu Traveller.

5.0 RISKS & DANGERS MAY ARISE FROM FORESEEABLE OR UNFORESEEABLE CAUSES.

You also realize and acknowledge that risk and dangers may be unintentionally and inadvertently caused by the owners, employees, subcontractors, or agents of Vanuatu Traveller or the negligence or participation of other participants and/or guests. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature. You fully understand and acknowledge that the aforementioned risks, dangers and hazards are a potential in connection with recreational activities which may take place during your time with Vanuatu Traveller. You further accept the risk and liability in undertaking any Trip, staying in Accommodation, and/or participating in a Tour or Walk organised by Vanuatu Traveller.

6.0 OUR DISCLAIMER OF LIABILITY.

Vanuatu Traveller operates a number of Trips along with associated Tours & Walks possessing varying degrees of difficulty and dangers. The nature of the Tours & Walks is a good part of the attraction and while we take all care, it is impossible for us to warrant peoples safety. All Guests and Participants book and participate in our Tours & Walks solely at their own risk.

1.0 THEFT OR INJURY.

Neither Vanuatu Traveller nor its staff, associated tourist operators, nor its agents take any responsibility for the loss or theft of your personal property or for any bodily injury that occurs on or at any property, nor on any Tour or Walk booked through Vanuatu Traveller. We recommend all guests purchase travel insurance to cater for any such eventualities.

2.0 EXISTING DAMAGE TO PROPERTY.

If on arrival at your accommodation, you notice any existing damage or breakages that are not consistent with the nature and locale of the property, you must report your concerns regarding the condition of the accommodation to us immediately after your arrival. Otherwise it is agreed that all is in order with the property.

3.0 UNREASONABLE DAMAGE THAT IS CAUSED BY YOU.

You will be held responsible for any unreasonable damage, breakages, theft or loss on or in any propery booked through Vanuatu Traveller shown to have been caused by you during your time on the property. If any premises is affected in this manner, that is not consistent with the nature and locale of that premise, you will be responsible for all related costs for the repair or replacement of the affected premise. You authorise us to charge you and you agree to pay these costs.

1.0 TRAVEL INSURANCE IS NOT INCLUDED IN OUR PRICES, QUOTES OR PROVIDED SERVICE.

Travel Insurance is NOT included in our Prices and Quotes to you. We endorse the recommendation of the Department of Foreign Affairs of your own Country that all travellers take out travel insurance. It is your personal responsibility to purchase your own travel insurance to cover any liability or contingency which may occur. If in any doubt, you should contact a qualified travel insurance professional.

2.0 YOUR TRAVEL INSURANCE.

Your travel insurance should provide cover against personal accident, death, medical expenses and emergency repatriation, with sufficient cover in each of the above categories. We also strongly recommend that it covers cancellation, curtailment, person liability, loss of luggage, and personal effects. In particular, consideration should be given regarding ALL clauses of these Terms and conditions conditions and you should ensure that you are informed of your risks and insurance coverage. Your travel insurance company should be able to advise you on an adequate level of cover.

1.0 BUILDINGS ARE NON SMOKING.

All buildings are non smoking, Guests / Participants agree not to smoke within any buildings booked through or entered as a consequence of their booking through Vanuatu Traveller and to remove and dispose of any butts etc of any of their members in a safe manner.

2.0 NOISE RESTRICTIONS.

Guests / Participants shall contain noise at a reasonable level and, in particular, between 10pm and 8am.

3.0 CUSTOMER BEHAVIOUR.

Guests / Participants shall not engage in any drunken, obscene or antisocial behaviour.

4.0 SHOW RESPECT AND BE COURTEOUS.

Guests / Participants Customers shall at all times show respect and behave courteously towards Vanuatu Traveller staff, associated Tour operators, their families, and other Vanuatu Traveller Guests and/or Participants. Further, Guests / Participants shall at all times show respect towards local Ni-Vanuatuan Kastom and culture.

5.0 REQUESTS BY VANUATU TRAVELLER STAFF AND ASSOCIATED TOURIST OPERATORS.

Where Vanuatu Traveller staff or associated tourist operators make requests of Guests / Participants in accordance with these Terms and Conditions, these shall be complied with by Guests / Participants.

6.0 TERMINATION OF A GUESTS STAY, OR PARTICIPANTS PART OR PLACE IN A TOUR OR WALK.

Vanuatu Traveller, our associated Tourist Operators, or Agents reserve the right to terminate the occupancy of any Guest on a booked Property, or terminate any participant on a Vanuatu Traveller booked Tour or Walk, who :

  • Are Intoxicated and/or Display unsavoury/lewd behaviour; or
  • Wilfully damage any Property, Vehicles or Buildings; or
  • Physically or verbally abuse/assault any Vanuatu Traveller staff, our associated Tourist Operators, or Agents, other guests / participants, members of the public on or around any Vanuatu Traveller booked Property, or on a vanuatu Traveller booked Tour or Walk; or
  • Display any behaviour deemed as a potential safety threat to others; or
  • Are the focus and cause of any incident for which police are required to attend.
7.0 CONSEQUENCE OF A GUESTS / PARTICIPANTS TERMINATION.
  • Notice of Termination may be given either in writing or verbally. Where termination is given verbally it shall be followed up by a written statement including the reason for the termination; and
  • Terminated Guests / Participants will leave immediately and shall NOT have any right or recourse whatsoever for any eviction, or termination of their Stay, or Participation in a Tour or Walk.
